Congress ceded authority a long time ago when they passed laws that said that unelected bureaucrats could, effectively, write laws.

IHMO: When Congress did that, they violated the Constitution. Therefore those laws are null and void and the "rules" made by the bureaucracy have no authority.

Additionaly, congress started cedeing authority LONG before the affordably care act.
